Ratio Decidendi

The court found that the appeal was instituted in the name of the appellant, who had died on 15th October 2008. Under Section 82(a) of the Law of Succession Act, only a personal representative with a grant of representation can bring proceedings on behalf of a deceased person. The record showed that no such grant had been made, and the trial court had previously noted that the appellant's counsel and family concealed the death to avoid execution of judgment. The court held that the appeal was fatally defective and a nullity, as legal proceedings cannot be instituted in the name of a deceased person. The preliminary objection was therefore meritorious and the appeal was struck out.
