Procedural Posture

Succession Cause / Ruling on Application for Leave to Appeal and Status Quo Orders

  1. 1 Whether the applicant should be granted leave to appeal to the Court of Appeal against the judgment delivered on October 21, 2022.
  2. 2 Whether an order maintaining the status quo in respect of the disputed properties should be issued pending appeal.

Ratio Decidendi

The court found that the Law of Succession Act does not provide an automatic right of appeal to the Court of Appeal and that leave must be sought from the High Court. The applicant failed to demonstrate any serious grievance or substantial prejudice that would warrant granting leave to appeal or maintaining the status quo. The court was not convinced that there were grounds meriting serious consideration by the appellate court, nor was there evidence of imminent loss or interference by the respondent. Accordingly, the application for leave to appeal and for status quo orders was dismissed, but the applicant was informed of her liberty to seek leave from the Court of Appeal.
