The court found that although the applicants complied with the conditions for stay of execution and filing the appeal out of time outside the stipulated period, the delay was explained and justified by financial constraints arising from the Covid-19 pandemic, a matter of judicial notice. The respondent had already received half the decretal sum and the balance was secured in a joint account, thus no prejudice would be suffered by the respondent. The court held that it retained discretion to enlarge time for compliance with its orders and that the doctrine of res judicata did not apply as the issues in the present application were not identical to those previously determined.
