The High Court found that the judgment on record in the subordinate court was invalid and irregular for want of signature and lack of evidence of pronouncement in open court, as required by the Civil Procedure Rules. Consequently, the decree issued on the basis of the unsigned judgment was also irregular and void. The trial court, having set aside the irregular decree, erred in subsequently finding itself functus officio, as there was no valid judgment to bring the matter to finality.
