The court held that the mandatory one-year threshold under Order 17 Rule 2 of the Civil Procedure Rules had not been satisfied, as the Plaintiff had taken steps to set the matter down for hearing prior to the application for dismissal. Consequently, the Defendant's application for dismissal for want of prosecution lacked merit and was dismissed.
