Ratio Decidendi

The court found that the suit property was jointly registered in the names of the plaintiff and defendant pursuant to the amended certificate of confirmation of grant in the succession cause. The defendant admitted that the property was not listed as an asset of their late father and thus not available for distribution among other beneficiaries. The court held that, in the absence of any indication to the contrary, the law presumes that the property is held in common in equal undivided shares. Therefore, the plaintiff was entitled to an order for subdivision of the property into two equal portions, one for each party.
