The court found that the claimant's demotion was not unlawful as it was contractually sanctioned and followed a disciplinary process. However, the summary dismissal was procedurally unfair because the respondent failed to provide the claimant with an oral hearing in the presence of a representative as required by section 41(2) of the Employment Act, 2007. Despite this procedural lapse, the respondent had valid and fair substantive reasons for dismissal, namely habitual absence, dishonesty, and insubordination, which were not effectively challenged by the claimant.
