Ratio Decidendi

The High Court determined that it lacks jurisdiction to entertain the applicant's request for further sentence reduction because the applicant had already exercised his right of appeal up to the Court of Appeal, which had pronounced itself on the sentence. The doctrine of functus officio precludes the High Court from revisiting or altering a sentence that has been reviewed and determined by a higher court. As such, the application for sentence reduction is untenable in law and must be dismissed for want of jurisdiction.
