The court held that the Appellant did not specifically plead the statute of limitation in his defence as required by Order 2 Rule 4 of the Civil Procedure Rules, and therefore could not rely on limitation as a defence. Even if limitation were considered, the claim was for recovery of land, which is subject to a 12-year limitation period under section 7 of the Limitation of Actions Act, not the six-year period for contracts. The Respondent had paid the full purchase price, taken possession, and performed his obligations under the contract.
