Ratio Decidendi

The Court of Appeal held that the order striking out the applicant's suit was a negative order, not capable of execution or enforcement, and therefore not capable of being stayed under Rule 5(2)(b) of the Court of Appeal Rules. Since the suit no longer existed, there was nothing to stay. The applicant failed to satisfy the first principle of demonstrating an arguable appeal, and as such, the application for stay of execution could not succeed. The motion was dismissed accordingly.
