Procedural Posture

Civil Appeal / Judgment

  1. 1 Whether the deceased was an 'insured authorised driver' under the insurance policy and entitled to compensation.
  2. 2 Whether the insurance policy extended coverage to a driver authorized by an employee of the insured, rather than by the insured directly.

Ratio Decidendi

The court found that the insurance policy expressly extended coverage only to the 'insured authorised driver,' which in this case was Mr. Orlando, the employee of the 1st respondent to whom the vehicle was allocated. The deceased, having been authorized to drive by Mr. Orlando and not directly by the insured (1st respondent), did not fall within the definition of 'insured authorised driver' under the policy. The policy did not support the extension of coverage to drivers authorized by employees of the insured. Therefore, the insurer was not liable to compensate the estate of the deceased, and the subordinate court's dismissal of the suit was upheld.
