Ratio Decidendi

The court held that since the applicant was entitled to appeal against the sentence but chose not to do so, he could not invoke the court's revisionary jurisdiction under Sections 362 and 364 of the Criminal Procedure Code. Section 364(5) expressly bars revision proceedings at the instance of a party who could have appealed but did not. The applicant's approach to the court for revision was therefore incompetent and contrary to the law. The court struck out the revision for want of jurisdiction to entertain it at the applicant's instance.
