There was no evidence that the Respondent terminated the Claimant's employment, nor was there any demonstration of constructive dismissal. As such, the claim for unfair termination and related compensation could not be sustained. However, the court held that the Respondent, having admitted to receiving the Claimant's Diploma Certificate from the African Milling School, was not entitled to withhold it.
