Ratio Decidendi

The court held that the application for dismissal for want of prosecution was premature because no directions had been given in the appeal as required by Order 42 Rule 13 of the Civil Procedure Rules. The court found no evidence that the appellant had applied for a copy of the decree before April 2017, and thus the appellant could not blame the lower court for delay. However, the court noted that the appellant was guilty of inordinate delay in prosecuting the appeal but, since the procedural requirement of directions had not been met, the application for dismissal could not succeed. Each party was ordered to bear its own costs.
