Ratio Decidendi

The court found that the claimant failed to justify the necessity of most of the requested documents except for the clock-in books, which were relevant to the disputed issue of untaken leave days. The respondent had already produced extracts of the clock-in books and had no valid reason not to comply with the notice as concerns these records. The court therefore ordered the respondent to make discovery on oath and deliver copies of the clock-in books for the specified period to the claimant at least 14 days before the pre-trial date. The request for other documents was denied as they were either non-existent, irrelevant, or not in the respondent's possession.
