Ratio Decidendi

The court found that the respondent's licence to operate as a collective management organization had expired on 31st December 2016 and that the Kenya Copyright Board had declined to renew it, directing the respondent to cease all royalty collection activities. Despite this, the respondent continued to collect royalties, in breach of statutory provisions and regulatory directives. The applicants established a prima facie case with a probability of success, as the respondent was acting without legal authority. The court held that public interest favored restraining the respondent from illegal collections, and thus granted the temporary injunction sought by the applicants.
