Such an association must institute proceedings through its officials or nominated persons who have the consent of the members. The defect of lacking legal capacity is substantive and cannot be cured by amendment or by invoking Article 159(2)(d) of the Constitution. Since the Kisumu Bar Owners Association filed the petition and application in its own name, without joining its officials as parties, the proceedings were incompetent.
