The court found that although the plaintiff and its directors were aware of the order of 15th January 2008, the order was not sufficiently clear as to its application to the plaintiff, and the status quo order was ambiguous. The plaintiff had, on legal advice, withdrawn the suit and believed no active litigation or subsisting order remained. Furthermore, by operation of Order 40 Rule 6 of the Civil Procedure Rules, 2010, any interlocutory injunction or status quo order lapsed after 12 months from the coming into force of the new rules unless extended by the court, which was not done.
