Miscellaneous Criminal Application / Ruling on Revision Application Seeking Resentencing

  1. 1 Whether the High Court can entertain a resentencing application when an appeal is pending before the Court of Appeal.
  2. 2 Whether the High Court is functus officio after determining the first appeal and substituting the sentence.

Ratio Decidendi

The High Court held that it had already pronounced itself on the issue of sentence in the applicant's first appeal and that there is a pending appeal before the Court of Appeal. As such, the High Court is functus officio and is precluded by law from making any further orders on the same issue while the matter is pending before the appellate court. The applicant's only recourse is to pursue his appeal in the Court of Appeal and not to initiate parallel proceedings in both courts. Consequently, the application for resentencing was dismissed.
