The Court found that while the applicants promptly filed notices of appeal and requested proceedings, there was an inordinate and unexplained delay of over one year and five months after obtaining the proceedings and certificate of delay before seeking to file the record of appeal. The applicants failed to provide a plausible explanation for this delay. For the ruling dated 5th October 2023, the applicants did not even exhibit a memorandum of appeal, failing to demonstrate an arguable appeal. The Court held that the requirements for extension of time under rule 4 were not met, and granting the orders would prejudice the respondent by delaying the administration of the estate....
