The court found that the Respondent failed to comply with both the procedural and substantive requirements for lawful termination under the Employment Act. The Respondent did not provide sufficient evidence of poor performance or absenteeism as valid and fair reasons for dismissal, nor did it follow the mandatory procedure of notification and hearing as set out in Section 41. The contract did not clearly require the Appellant to work on public holidays, and any miscommunication should not be held against her.
