The court held that the purpose of a stay order in criminal proceedings is to stop all proceedings in the subordinate court, including mentions, until the High Court determines the pending application. Requiring the accused to attend mentions defeats the purpose of the stay, exposes the accused to unnecessary inconvenience and expense, and wastes judicial resources. The trial court's insistence on mentions was therefore in violation of the stay order. The High Court found that the applicant had made out a case for the grant of the orders sought and accordingly stayed all proceedings, including mentions, in the subordinate court pending determination of the transfer application.
