Procedural Posture

Criminal Revision / Ruling on Preliminary Objection

  1. 1 Whether the High Court has jurisdiction to review a sentence already confirmed by a court of concurrent jurisdiction.
  2. 2 Whether the applicant's Notice of Motion is properly before the court given the prior appeal and confirmation of sentence.
  3. 3 Whether the preliminary objection on jurisdiction raised by the respondent is merited.

Ratio Decidendi

The High Court lacks jurisdiction to review a sentence that has already been confirmed by a court of concurrent jurisdiction on appeal. The applicant's conviction and sentence were previously appealed and dismissed in HCCRA No. 25 of 2019, with the sentence confirmed. The applicant's attempt to seek review through a Notice of Motion is therefore incompetent, as the court cannot revisit or alter the sentence in these circumstances. The preliminary objection raised by the respondent is meritorious and must be upheld, resulting in the dismissal of the application for want of jurisdiction.

Court Disposition

preliminary objection upheld; application dismissed for want of jurisdiction
