Ratio Decidendi

The court found that the applicant has a legitimate interest in the suit land both in his own right and as a representative of his late father.s estate, who was acknowledged by the plaintiffs as a beneficiary of the land. The plaintiffs did not oppose the application for joinder, and the defendants failed to demonstrate that the applicant.s previous suit (HCCC No. 51 of 2005) covered the same issues as the present suit. The court held that the applicant.s presence is necessary for the effective and complete adjudication of the matters in dispute, and that the doctrine of res judicata did not apply in the circumstances. Accordingly, the application for joinder was allowed.
