Procedural Posture

Criminal Appeal / Judgment

  1. 1 Whether the prosecution proved the charges of defilement and indecent act with a child beyond reasonable doubt.
  2. 2 Whether the trial court properly evaluated the evidence and the credibility of witnesses.
  3. 3 Whether contradictions and discrepancies in the prosecution's case were material to the outcome.

Ratio Decidendi

The High Court, upon fresh evaluation of the evidence, found that the prosecution proved beyond reasonable doubt the offences of defilement and indecent act with a child in respect of two complainants. The court held that the testimonies of the victims, corroborated by medical and other witness evidence, were credible and consistent on material facts, notwithstanding minor discrepancies regarding dates. The appellant's defence of frame-up was unsupported by evidence and did not raise reasonable doubt. The court found that the trial court erred in treating the indecent act as an alternative count rather than a separate offence, and corrected this by convicting the appellant on both counts....

Court Disposition

Appeal dismissed. Convictions upheld and sentences enhanced.

Orders

  • Conviction for defilement (Count II) substituted for alternative indecent act conviction; sentence enhanced to 20 years imprisonment.
  • Conviction for indecent act with a child (Count II) upheld as a separate count; sentence of 10 years imprisonment confirmed.
