Ratio Decidendi

The court held that an advocate's lien over client property is only exercisable when the advocate-client relationship exists and the costs in question have been incurred and ascertained through taxation. In this case, the respondent's fees have not been finalized because a reference challenging the taxation is pending. Therefore, the respondent cannot lawfully retain the applicant's Title Deed as a lien for fees that are yet to be determined. The respondent received the title with instructions to effect a transfer and cannot now claim a lien over it. The court ordered the immediate release of the Title Deed to the applicant and awarded costs to the applicant.
