Procedural Posture

Miscellaneous Application / Ruling on Notice of Motion to Adopt Director's Assessment

  1. 1 Whether the Employment and Labour Relations Court has jurisdiction to adopt an award by the Director of Occupational Safety and Health before the Director's process is complete.
  2. 2 Whether the application is premature given the pending objection before the Director of Occupational Safety and Health Services.
  3. 3 Whether the Work Injury Benefits Act allows the Court to intervene at this stage.

Ratio Decidendi

The Court determined that it lacks jurisdiction to adopt the Director of Occupational Safety and Health Services' assessment before the Director's process is complete. The Work Injury Benefits Act confers only appellate jurisdiction on the Employment and Labour Relations Court, which can only be invoked after the Director has made a final determination and any objections have been addressed. Since the Respondent's objection to the assessment is still pending before the Director and no final decision has been rendered, the application is premature and not properly before the Court. The Court therefore struck out the application for want of jurisdiction.
