The court found that Civicon Limited does not have possession of the Seperator, as it is stored in a Customs Warehouse for which the Plaintiffs pay rent to the Kenya Revenue Authority (KRA). Under the East African Community Customs Management Act, possession and control of goods in a customs warehouse rest with the customs authorities, not with the owner of the land or any third party. Since possession is a prerequisite for asserting a general lien, Civicon's claim fails. Furthermore, goods under customs control and destined for export cannot be subject to a lien by a third party.
