Procedural Posture

Miscellaneous Application / Ruling on Application to Extend Time for Filing Suit and Transfer to Industrial Court

  1. 1 Whether the court can extend time to allow commencement of a suit based on contract after the limitation period has lapsed.
  2. 2 Whether the applicants are entitled to an order transferring the suit to the Industrial Court Registry for expeditious disposal.

Ratio Decidendi

The court held that, in light of binding authority from the Court of Appeal and the clear wording of section 4(1) of the Limitation of Actions Act, it has no jurisdiction to extend time or grant leave for the commencement of a suit based on contract after the limitation period has expired. The applicants' claim, being founded on contract and brought outside the statutory six-year period, is statute-barred. The court therefore declined to grant the extension sought and dismissed the application.
