The Court found that while the applicant raised an arguable issue regarding whether the trial court properly evaluated the evidence, particularly on sound emission audits, the applicant failed to demonstrate that the appeal would be rendered nugatory if a stay was not granted. The Court was not persuaded that closure of the applicant's business, especially in light of the existing closure due to the Covid-19 pandemic, would result in irreparable harm that could not be remedied if the appeal succeeded. The applicant did not meet the dual threshold required for stay of execution under rule 5(2)(b) of the Court of Appeal Rules. Consequently, the application for stay was dismissed.
