Ratio Decidendi

The court found that although the High Court appeal had been determined and the deposit condition fulfilled, the existence of a further appeal to the Court of Appeal distinguished this case from authorities where no further appeal was pending. Releasing the funds at this stage could render the pending appeal nugatory if successful. The court held that the overriding objective of the Civil Procedure Act would be best served by retaining the deposit until the appellate process is concluded, thereby safeguarding the interests of both parties and ensuring that the appeal is not rendered academic.
