Ratio Decidendi

The court found that the applicant had established a prima facie arguable case regarding the alleged error by the Hon. Kadhi in disallowing the amendment of the statement of defence. The application for stay was filed expeditiously, only 14 days after the impugned ruling. The court determined that if proceedings in the Kadhi's Court continued before the appeal was heard, the appeal could be rendered nugatory, causing prejudice to the applicant. Therefore, in the interest of justice, the court exercised its discretion to grant a stay of proceedings pending the determination of the appeal, subject to the timely filing of the record of appeal.
