Ratio Decidendi

The court held that it lacked jurisdiction to revisit or set aside its own ruling delivered on 13th July 2023, as the matter had been determined on its merits and the court was functus officio. The doctrine of functus officio precluded any merit-based re-engagement with the dispute. Additionally, the applicant failed to demonstrate substantial loss that would warrant the grant of stay of execution pending appeal. The sum in question was held as security pending the reference, which had since been determined, and there was no evidence that the respondent would be unable to satisfy any future decree. The application was therefore dismissed for want of jurisdiction and lack of merit.
