The court found that although the objector demonstrated ownership of the motor vehicle KCP 104S, the sale of the vehicle had already occurred pursuant to a valid court order and after proper notice of sale was published. The application for stay and review was filed before the sale, but no orders were issued to halt the sale, and the sale proceeded as directed by the court. As such, the court held that it cannot grant orders to stay or reverse an event that has already taken place, as such orders would be in vain. The application was therefore struck out as the reliefs sought were no longer available.
