The court found that the applicant was only in pre-trial custody for 5 days, from May 28, 2019 to June 3, 2019, before being convicted and sentenced in another case. From June 3, 2019 onwards, the applicant was serving a lawful sentence for a different offence and was not in pre-trial detention for the present matter. Section 333(2) of the Criminal Procedure Code only requires the court to account for actual pre-trial custody, not periods when the applicant was serving another sentence. The trial court was not obligated to deduct the entire period from arrest to sentencing, as the applicant was not in remand for the present offence during that time.
