Miscellaneous Application / Ruling on Application to Extend Stay of Execution Orders

  1. 1 Whether the court should review and extend the orders staying execution of the judgment and decree of the trial court pending determination of the application for leave to appeal out of time.
  2. 2 Whether the applicant has provided sufficient justification for the extension of stay orders after their lapse.
  3. 3 Whether the respondent will suffer prejudice if the orders sought are granted.

Ratio Decidendi

The court found that although the applicant's advocates failed to act promptly after the lapse of the initial stay orders, the application for extension was unopposed and the applicant had deposited security as previously ordered. The court determined that refusing the extension would prejudice the applicant by denying him the opportunity to have his application for leave to appeal heard on merit, while there was no evidence of prejudice to the respondent. Accordingly, the court exercised its discretion to extend the stay of execution orders pending the next hearing or mention date.
