Procedural Posture

Civil Suit / Ruling on Post Judgment Application (notice of Motion Dated 17th June, 2010)

  1. 1 Whether the defendant is entitled to mesne profits pursuant to the consent order of 19th November, 2009.
  2. 2 Whether the plaintiff should be permitted to vacate the premises unconditionally.
  3. 3 Whether any claims arising after 31st March, 2010 can be determined in the present suit.

Ratio Decidendi

The court found that the consent order of 19th November, 2009 was intended to fully compromise the suit and that no provision was made therein for the payment of mesne profits to the defendant. The defendant's application for mesne profits was therefore misconceived, as such relief was not awarded in the consent order nor in any subsequent order. The court further held that any claims relating to periods after 31st March, 2010, including claims for mesne profits or continued occupation, must be the subject of fresh litigation, as the present suit was compromised by the consent order. The court also determined that the plaintiff should be permitted to vacate the premises unconditionally...

Court Disposition

Defendant's application dismissed; plaintiff permitted to vacate premises; accounts to be taken; further claims to be litigated afresh.

  • The defendant shall forthwith and unconditionally permit the plaintiff to vacate the suit premises.
