Civil Suit / Ruling on Application to Set Aside Judgment

  1. 1 Whether the ex-parte judgment delivered on 16th December, 2014 should be set aside.
  2. 2 Whether the Defendant's failure to attend the hearing was excusable.
  3. 3 Whether the injunctive order has been overtaken by events.

Ratio Decidendi

The court found that the Defendant's advocate was properly served with the application, court order, and hearing notice, and no explanation was provided for their absence at the hearing. The Defendant failed to demonstrate that the non-attendance was excusable or that there was any merit in setting aside the ex-parte judgment. Furthermore, the injunctive order previously granted had been overtaken by the Minister's decision in Land Appeal Case No. 226 of 1998, which resolved the substantive dispute in favour of the Plaintiff. The application to set aside the judgment was therefore dismissed as unmeritorious.
