Ratio Decidendi

The High Court found that the Kadhi's court had set aside its own judgment of 21st August 2015 via the ruling of 5th May 2016, which remained in force and was never overturned. As a result, the main suit was pending a fresh hearing with all interested parties, including those newly enjoined. The appeal, which purported to challenge a judgment that no longer existed, was therefore moot. The court declined to address the merits of the appeal to avoid prejudicing the outcome of the rehearing. The only just course was to order the matter to start de novo before a different Kadhi, with the Chief Kadhi to allocate the case and expedite the hearing.
