Ratio Decidendi

The Court found that the applicant had satisfied both limbs required for the grant of stay or injunctive relief under Rule 5(2)(b): (1) he had demonstrated an arguable appeal, particularly on the interpretation and application of section 11 of the County Government (Amended) Act 2020 and the issue of residual powers in the Assembly's standing orders; and (2) the appeal would be rendered nugatory if the orders were not granted, as the applicant risked unlawful removal from office and the Assembly faced legislative paralysis and legal risk. The Court therefore allowed the application and granted the injunctive orders sought, pending the hearing and determination of the intended appeal.
