The High Court lacks jurisdiction to entertain the applications as the matters raised concern land use, occupation, and title, which fall exclusively within the jurisdiction of the Environment and Land Court under Article 162(2)(b) of the Constitution and the Environment and Land Court Act. The applications are further fatally defective as they were commenced by Notice of Motion without a substantive suit, contrary to the Civil Procedure Rules, and seek substantive orders against parties not properly joined.
