Procedural Posture

Tribunal Claim / Judgment

  1. 1 Whether the claimant is entitled to transfer of plots 172 and 173 of L.R 343/5 Lukenya Mavoko Municipality or a refund of the purchase price.
  2. 2 Whether the respondent breached the agreement by failing to transfer the plots after full payment.
  3. 3 Whether the claimant is entitled to interest and costs.

Ratio Decidendi

The tribunal found that the claimant had proved, through documentary evidence and uncontroverted testimony, that he paid the full purchase price for the two plots but the respondent failed to transfer them. Since the respondent did not defend the claim, the tribunal accepted the claimant's alternative prayer for a refund of the purchase price with interest at tribunal rates from the date of filing. The tribunal also awarded costs to the claimant. The decision was based on the principle that a purchaser who has fulfilled their contractual obligations is entitled to either the property or a refund if the seller fails to perform.
