The court found that the plaintiff's cause of action accrued in 1963, when the alleged fraudulent registration of the suit property occurred. The plaintiff's father, who was aware of the registration, took no action during his lifetime, and the plaintiff himself waited until 2018 to file suit, resulting in a lapse of 55 years. Under Section 7 of the Limitation of Actions Act, actions to recover land must be brought within twelve years. Although Section 26 provides an exception for fraud, the court held that the plaintiff failed to demonstrate why the alleged fraud was not challenged during his father's lifetime or why the suit was filed so late.
