The trial court erred by ordering that sentences in default of a fine run concurrently instead of consecutively, contrary to law. However, considering the applicant is a first-time offender, has served about 5 months, is remorseful, and the Sentence Review Report recommends community service, the High Court exercises its revisionary powers to substitute the remaining custodial sentence with a community service order. This is in line with the objectives of prison decongestion and rehabilitation, and the applicant is deemed suitable for non-custodial supervision under close monitoring by local authorities and probation services.
