Legal Issues
- 1 Whether the applicant is entitled to have three months spent in custody deducted from his sentence of ten years imprisonment.
- 2 Whether the court can consider the application without supporting proceedings or confirmation of bond status.
Ratio Decidendi
The court dismissed the application because the applicant failed to provide supporting proceedings or evidence to confirm whether he was on bond during trial. Without such documentation, the court could not verify the applicant's claim of having spent three months in custody prior to sentencing. The court emphasized that for consideration of time spent in custody to be deducted from a sentence, the application must be supported by relevant proceedings and the charge sheet. The absence of these documents rendered the application unmerited and incapable of being granted at this stage.
Court Disposition
application dismissed
Orders
- The application is dismissed.
- The applicant may file a fresh application with supporting proceedings and charge sheet.
