The court found that, given the penal nature of contempt proceedings and the need to ensure due process, the appellants should be given an opportunity to argue their appeal while on bond. The court noted that the stay order had already been reviewed and varied, and the appellants had been released on cash bail of Kshs 2,000 each pending the hearing and determination of the application. In the interest of justice, and without delving into the substantive merits of the appeal, the court ordered that the appellants remain on bond on the same terms pending the appeal.
