The issuance of the Direct Nomination ticket to the Complainant was found to be illegal, contrary to fair administrative action, and in violation of both the ODM Party Primaries and Nomination Rules and the Tribunal's stay orders. The Tribunal held that the 1st Respondent's legitimate expectation to a fair process was violated, as there was no consultation or consensus in the nomination process.
