The court also noted that the intended appeal was not frivolous, especially in light of statutory amendments allowing appeals on both facts and law from the Employment and Labour Relations Court. Accordingly, the court exercised its discretion to extend time for filing the appeal, finding the application meritorious and unchallenged.
