The respondent, having raised the issue of the rider's negligence, had a duty to enjoin the rider as a third party under Order 1 Rule 15 of the Civil Procedure Rules. By failing to do so, the respondent must bear full liability. The court also held that the existence of an unchallenged test suit does not bar an appeal against a decision based on that test suit.
