Ratio Decidendi

The court found that the Land Disputes Tribunal acted in excess of its jurisdiction by purporting to determine a dispute over ownership and title to land registered under the Registered Land Act. Section 3(1) of the Land Disputes Tribunals Act restricts the Tribunal's jurisdiction to matters of boundaries, occupation, or trespass, and does not extend to ownership or contractual disputes. The Tribunal's award of specific performance and damages, as well as the subsequent adoption of the award by the magistrate's court, were therefore nullities. The High Court, exercising its supervisory jurisdiction, quashed the Tribunal's decision and prohibited its implementation.
